The Association of Professional Societies in East Africa - APSEA now says politicians are interfering with the implementation of the constitution.While delivering a statement on the position of APSEA on the implementation of the Constitution at a Nairobi hotel Thursday, APSEA Chairman Dr. Daniel Ichang'i says political utterances made against the Independent Electoral and Boundaries Commission (IEBC) Selection Panel do not augur well in ensuring that the country has an independent electoral body. "It is therefore very sad to see some of our elected leaders appear to suggest that some Kenyans are more special than others. This is tantamount to tampering with the electoral process and is not in keeping with the national values and principle of governance as enshrined in the Constitution of Kenya, 2010," said Ichang'i. He at the same time warned the government against piecemeal amendments to the constitution including the change of the election date from August to December, he noted that, "We owe this to ourselves, our children and our grandchildren and Kenyans still to come," and added that, "elections of the President, Deputy President and members of parliament shall be held on the second Tuesday of August, meaning Tuesday, 14th August, 2012." While delivering a statement on the position of APSEA on the implementation of the Constitution, Dr. Ichang'i urged the public not to view the devolution as a form of federalism. "It is neither federalism nor the creation of 47 small governments, but it is the devolution of national resources and services to areas that have born the brunt of under-development on account of past sessional papers that did not address the plight of those very areas," he said. Ichangi said the burden of sustaining the county governments should not be placed on the public but modalities that ensure equity be put in place to ensure that the process is to the benefit of all. "Devolution is not intended to cause suffering to the ordinary Kenyans by placing upon them the increased burden of sustaining inefficient governance on account of bloated county administration and finance management structures." And the APSEA Convenor of the Public Affairs Committee Felix Okatch said objection of the devolved structure of governance is much the same as what happened at the introduction of the Constituency Development Funds - CDF but after structures were put in place, the CDF has turned out to be the major driver of development in the constituencies. APSEA is urging for logic in the way the implementation of the constitution is being done.
